Petitioner Derrick Morgan is before this Court on a petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254. In a report and recommendation dated January 6, 2000 (“Report and Recommendation”), Magistrate Judge Michael H. Dolinger recommended that the Court deny Morgan’s petition.
