OPINION On December 24, 1997, the Tuscarawas County Grand Jury indicted appellant, Harold E. Ickes, on one count of felonious sexual penetration in violation of R.C. 2907.12, one count of rape in violation of R.C. 2907.02 and five counts of gross sexual imposition in violation of R.C. 2907.05.
