{1 The trial court defendant, Joe Don Eaves ("Eaves"), appeals the order dismissing his motion to modify the divorce decree entered in a divorcee action between him and the trial court plaintiff, Marsha Michelle Eaves, now Huffman ("Huffman"), his former wife.1

12 Huffman sued Eaves for divorce in August 1994.
