Gelinas, J.

The Beverly school district brought an action in Superior Court under G. L. c. 150C, § 11, to vacate an arbitrator’s award reinstating James Geller to his position as a *291teacher in the district, albeit with a substantial penalty.1 A Superior Court judge granted summary judgment in favor of Geller, sustaining his reinstatement.
