PURYEAR, Justice.

Appellee Land Design Studio (“Land Design”) originally brought suit against Hugh L. Caraway and Internacional Realty, Inc. (“Realty”) to recover an amount due on a promissory note signed by Caraway, the president of Realty. Land Design moved for summary judgment against Caraway and Realty. The trial court granted the motion against Caraway, but denied the motion against Realty.
