This is an appeal from a judgment obtained against Appellant, Progressive Casualty Insurance Company, (Progressive) resulting from an equitable garnishment proceeding.

Respondent, Shanna Christian, (Christian) had earlier obtained a judgment against Progressive’s insured, Richard Maschmeyer, (Maschmeyer) arising from Christian’s claim for the wrongful death of her son, Dustin Gaines.
