Defendant, Julio A. Ramirez, appeals the judgment of conviction entered upon jury verdicts finding him guilty of second degree assault after provocation and felony menacing. The People cross-appeal the trial court's order granting defendant a new trial on the burglary charge and its related erime of violence count.
