Appellant Richard Caldwell filed a petition for a writ of habeas corpus under 28 U.S.C. § 2254 in the United States District Court for the Western District of Tennessee on June 23, 1997. Upon reviewing the petition, the district court granted summary judgment in favor of Appellee and issued a certificate of appealability to this Court.
