This matter involves an appeal by the State from an order granting appellee Jackie Lee Stapleton’s petition for a writ of habeas corpus. The facts leading up to this order are these. On April 29, 1987, Stapleton pled guilty to two counts of aggravated robbery, two counts of theft of property, and one count of aggravated assault.
