On 9 August 1991, the petitioner was convicted in absentia before a general court-martial composed of officer members of desertion, rape, and assault consummated by a battery, in violation of Articles 85, 120, and 128, Uniform Code of Military Justice, 10 U.S.C. §§ 885, 920, and 928. He was sentenced to confinement for seven years, forfeiture of $753.
