On October 20, 1999, Richard J. Horwath1 and Kathryn Horwath, husband and wife, commenced this action by filing a complaint against Carlisle Brownmiller and Marian Brownmiller, husband and wife. In response, defendants filed preliminary objections to plaintiffs’ complaint on December 6, 1999, which this court disposed of by opinion and order dated March 3, 2000.
