[¶ 1] Zagonyi Tungate appeals from the judgment entered in the Superior Court (Cumberland County,

Mills, J.)

dismissing her claim against William D. Gardner Jr. on res judicata grounds. Because we conclude that the first element of res judicata has not been satisfied, we vacate the judgment.
