MEMORANDUM OPINION

BRINKEMA, District Judge.

This matter is before the Court on defendant’s Motion to Dismiss plaintiffs complaint. For the reasons set forth below, the motion will be granted.

BACKGROUND

This case arises out of efforts by the United States Patent and Trademark Office (“PTO”) to implement the Inventors’ Rights Act of 1999 (“IRA”). 35 U.S.C. § 297 (2002).
