OPINION

SWEET, District Judge.

Defendant Dr. Felicitas Miraflor (“Mi-raflor”) has moved pursuant to Fed. R.Civ.P. 56 for summary judgment to dismiss the complaint of plaintiff Richard Cole (“Cole”), a prison inmate, alleging violations of 42 U.S.C. § 1983.

For the reasons set forth below, the defendant’s motion will be granted.
