On December 19, 2001, Plaintiff Moody National Bank of Galveston (“MNB”) filed suit against Defendant St. Paul Mercury Insurance Company (“St.Paul”) in the 56th Judicial District Court of Galveston County, Texas, alleging causes of action for breach of insurance contract, violations of the Texas Insurance Code, Tex.Ins.Code arts.
