—Appeal from an order of Monroe County Court (Connell, J.), dated May 4, 2001, which granted defendant’s motion to dismiss the indictment pursuant to CPL 30.30.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously reversed on the law, the motion is denied, the indictment is reinstated and the matter is remitted to Monroe County Court for further proceedings
