The appellants (hereafter “Employees”), over 200 former employees of Whitaker Coal Corporation (‘Whitaker”), a mining corporation owned by Sunoco, Inc. (“Sunoco”), brought this action under the Employee Retirement Income Security Act (ERISA) of 1974, 29 U.S.C. §§ 1001 et seq.
