Petitioner Gary Cohen was convicted of various sexual abuse charges after a trial

in New York state court. Cohen subsequently petitioned for a writ of habeas corpus, alleging that his federal constitutional right to be present at trial had been violated when some portions of the

were conducted without his participation.
