The plaintiffs, Heath and Tara Carey (“the Careys”) brought this action to enjoin the State Fire Marshall and the Department of Telecommunications and Energy (“DTE”) from proceeding with their investigation of the cause and origin of a fatal explosion of the Carey’s home on July 24, 2002.
