This issue comes before the Court on Defendant K.B.B. Corp., d/b/a RE/MAX’s (hereinafter “RE/MAX”) Brief in Support of its Positions. In its brief, RE/MAX contends that it is not a proper party because Hall was not acting as its agent when pursuing the sale of the 313 Freemason Condominium units and Hall had no apparent authority.
