PROCEDURAL HISTORY

Plaintiff Reynaldo Oyuela (Oyuela) claims to have injured his back when he attempted to move a heavy deck plate from its stowed position in the M/V SMIT LLOYD 25’s engine room. The M/V SMIT LLOYD 25 is an offshore supply vessel, which at the time was servicing a drilling rig located off the coast of Nigeria.
