Counterclaim defendants Merrill Lynch & Co., Inc. (“ML & Co.”) and Merrill Lynch Capital Services, Inc. (“MLCS”) (collectively, “Merrill Lynch” or “counterclaim defendants”) move to dismiss each of the four counterclaims asserted by counterclaim plaintiffs Allegheny Energy, Inc. (“Allegheny Energy”) and Allegheny Energy Supply Co.
