MEMORANDUM OPINION AND ORDER

CASTILLO, District Judge.

The Government’s superseding indictment charges Michael Segal with seven counts of mail fraud (Counts One through Seven), one count of wire fraud (Count Eight), a Racketeer Influenced and Corrupt Organizations Act (“RICO”) count (Count Nine) as well as seven false statement counts (Counts Ten through Sixteen).
