Plaintiff Frank Fournier (“Fournier”) commenced this action on November 13, 2000, alleging copyright infringement and related state law claims against defendants McCann Erickson (“McCann”) and Microsoft Corporation (“Microsoft,” and collectively with McCann, “Defendants”). The matter is scheduled for trial before this Court on February 10, 2003.
