OPINION AND ORDER

SCHEINDLIN, District Judge.

On August 12, 2002, Baosteel America, Inc. (“Baosteel”) and its subrogated cargo insurer commenced this action against Hyundai Merchant Marine Co., Ltd. (“Hyundai”) and the vessel M/V “Ocean Lord” (“Ocean Lord”) to recover damages for cargo shipped from China to the United States.
