On May 30, 2001, Eulogio Pena was sentenced to an indeterminate term of incarceration of a minimum of 2 years to a maximum of 4 years, to be served consecutive to completion of a 16-year definite sentence then outstanding in an unrelated matter (Bronx County Indictment No. 4857/99).
