OPINION
TARNOW, District Judge.
Petitioner Mountain Top Tracking Co. (Mountain Top) appeals a final administrative decision of the Federal Mine Safety & Health Commission (Commission). The Commission affirmed a backpay award to Walter Jackson for Mountain Top’s discharge of Jackson in violation of the Mine Safety Act of 1977, 30 U.S.C. § 801, et seq (Mine Act).
