Oswald Kratz pleaded guilty to one count of conspiracy to distribute cocaine, see 21 U.S.C. §§ 846, 841(a), and was sentenced to 120 months’ imprisonment. He appealed his sentence, but we dismissed *933the appeal after concluding that he had waived his right to bring it in his plea agreement. Kratz then moved to vacate, set aside or correct his sentence, see 28 U.S.C.
