Johnny Cowherd, a Kentucky state prisoner, appeals through appointed counsel a district court order dismissing his petition *416for a writ of habeas corpus, filed pursuant to 28 U.S.C. § 2254, as barred by the one-year statute of limitations. Neither party has requested oral argument, and this panel unanimously agrees that oral argument is not necessary in this case. Fed. R.App. P. 34(a).
