Joseph Cary was injured during an after hours community service project sponsored by his employer, Gemtron Corporation ("Gemtron"), due to the alleged negli-genee of co-worker Donald Knoy. Cary filed suit against Knoy and Knoy filed a Motion to Dismiss, contending that the trial court lacked subject matter jurisdiction.
