LEMMON, District Judge.

Plaintiff Horace Kersey, a seaman, has sued defendant American River Transportation Company (Artco), his employer, for a back injury he alleges he sustained on January 29, 2003 while working aboard Artco’s vessel MTV SPARTAN. The parties agreed to bifurcate liability and damages for the non-jury trial.
