I. Background

This matter comes before the court on the parties’ cross motions for summary judgment pursuant to Fed.R.Civ.P. 56. Plaintiff seeks a declaration from this court that the tragic death of Kathy Marie Thompson (“Mrs. Thompson”) is a covered event under an automobile insurance policy issued by defendant, USAA Casualty Insurance Company (“USAA”).
