Lorillard Tobacco Company, the defendant and counterclaim plaintiff, has moved, pursuant to Court of Chancery Rule 59, for reargument of this court’s August 22, 2005 Opinion granting summary judgment in favor of American Legacy Foundation (“ALF”).
