THIS CAUSE came before the Court upon Plaintiffs Motion for A Temporary Restraining Order and Preliminary Injunction (D.E. No. 5), filed on

July 1, 2005.

For the reasons discussed below, Plaintiffs motion for a preliminary injunction is GRANTED in part and DENIED in part.
