Now before the Court is the motion (Dkt.#5) filed by defendant Corrections Corporation of America (“CCA”) to dismiss the complaint filed against it by plaintiff Brian L. Torres (“Torres”) for violation of 42 U.S.C. § 1983 and negligence, and the motion to amend (Dkt.# 8) filed by plaintiff Torres.
