This matter is before the Court on the above-named Plaintiffs motion to remand this case to state court. This case arises out of harm to Plaintiff allegedly caused by Vioxx, and the complaint alleges product liability claims against Merck and negligence claims against the physician who prescribed Vioxx to Plaintiff.
