ORDER
ANTOON, District Judge.
Plaintiff Lois Virkler (“Ms.Virkler”) brings this action for patent infringement and fraudulent inducement against Defendant Herbert Enterprises, Inc. (“HEI”). This case is before the Court on Defendant’s Motion for Summary Judgment of Noninfringement (Doc. 40), in response to which Ms. Virkler has filed a Memorandum in Opposition (Doc. 42).
