This case was commenced on January 8, 2004 by the United States of America against the City of Erie based on the United States’ allegation that the City’s use of a physical agility test from 1996 to 2002 as a device to screen police officer candidates violated Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e

et seq.
