The claims underlying this appeal arose when Kevin O’Brien terminated his brother, Mark O’Brien, from K-O Enterprises, Inc. (“K-O”), a closely held family business. Mark appeals two summary judgment orders entered by the Circuit Court of St. Louis County in favor of his brother, Kevin.
