On October 25, 2002, the plaintiff, Boston Police Officer Sean Flaherty (“Officer Flaherty”) filed a negligence claim against the defendant, Walgreen Eastern Co., Inc. (“Walgreeris”) and others. The Complaint alleged in part that Officer Flaherty was seriously injured due to the negligence of Walgreeris employee(s). Walgreeris has moved for summary judgment pursuant to Mass.R.Civ.P.
