INTRODUCTION

Plaintiff Smaland Beach Association, Inc. (“Sma-land”) brought this action against defendants Arthur and Patricia Genova (the “Genovas”) seeking to establish the ownership of a disputed parcel of land and to obtain a permanent injunction refraining the Genovas from interfering with Smaland’s use of the land.
