This appeal arises out of a state law bad faith claim against Government Employees Insurance Company (“GEICO”) and is before this court under diversity jurisdiction. After one of its insureds, Mr. Frances Quigley,1 caused a car wreck, GEICO failed to reach a settlement with Michelle Macola, an injured third party.
