RULING ON MOTION TO DISMISS

DORSEY, District Judge.

Defendants move, pursuant to Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure, to dismiss this action for lack of subject matter jurisdiction and for failure to state a claim. Plaintiff, Dia-nah Davis, filed her complaint on October 4, 2005 against Defendants United States of America and Martin Vega, Jr.
