INTRODUCTION

Petitioner, William A. Barnard, Jr. (“Barnard”), has filed a

pro se

petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 challenging his conviction in Niagara County Court on charges of use of child in a sexual performance (N.Y. Penal Law § 263.05).
