OPINION

McCUSKEY, Chief Judge.

On May 24, 2006, this court directed the parties to file affidavits regarding venue and compliance with Rule 40.1 of the Local Rules of the Central District of Illinois. Based upon the affidavits, and the applicable case law, this court concludes that venue is proper in this court.
