OPINION

Mattel, Inc. (“Mattel”) brought suit claiming that a Roekette doll sold by defendant Radio City Entertainment (“Radio City”) infringed plaintiffs copyrights in certain Barbie Dolls.1 The Court initially granted summary judgment to plaintiff, but the Court of Appeals remanded for trial. Mattel, Inc. v. Goldberger Doll Mfg. Co., 365 F.3d 133, 137 (2d Cir.2004).
