This case has been remanded for further proceedings on plaintiffs substantive due process claims under 42 U.S.C. § 1983.

426 F.3d 187, 203-04 (2d Cir.2005). Defendants have moved for summary judgment based on res judicata [Doc. # 115]. For the reasons that follow, the motion is granted.
