Plaintiff Naresh Mirchandani (“plaintiff’) suffered a broken leg and other alleged injuries on December 9, 2001 when he fell from a ladder while clearing his home’s gutters. (Paper No. 150 at 1). Plaintiffs claim that they purchased the ladder at a retail outlet of defendant Home Depot U.S.A. (“Home Depot”).
