OPINION AND ORDER

BROWN, Judge.

This matter comes before the Court on Defendant’s Motion to Dismiss Indictment (#21). For the reasons that follow, the Court GRANTS Defendant’s Motion.

BACKGROUND

In 1998 Defendant Milenko Krstic and his family applied for refugee status and immigration to the United States from Bosnia.
