I. INTRODUCTION

Sky Technologies, LLC (“Sky”) brings this cause of action against defendant Ari-ba, Inc. (“Ariba”) alleging infringement of U.S. Patent No. 6,141,653 (“the '653 patent”), U.S. Patent No. 7,149,724 (“the '724 patent”), and U.S. Patent No. 7,162,458 (“the '458 patent”).
